1. BINDING AGREEMENT
1.1. By accessing this website or finalizing a commercial transaction with 4UR Home (“the Seller”), the Purchaser (“the Customer”) irrevocably agrees to be bound by these Terms and Conditions.
1.2. These terms supersede any prior oral or written agreements and constitute the entire agreement between the parties.
2. PRODUCT REPRESENTATION AND ACCURACY
2.1. Visual Variance: Due to the artisanal nature of ceramic and glass serveware, the Seller does not guarantee that the product received will be a 100% color match to the digital representation on screen.
2.2. The "Mug Set" Clause: Products sold as sets (e.g., the 12-piece Black & White Mug Series) are curated units. The Seller reserves the right to substitute individual components of equal value if a specific SKU is discontinued, provided the aesthetic integrity of the set remains intact.
3. PRICING AND PAYMENT PROTOCOLS
3.1. VAT: All prices are quoted in South African Rand (ZAR) and are inclusive of Value Added Tax (VAT) unless otherwise stated.
3.2. Payment Finality: Orders will only be processed upon the "cleared funds" reflection in the Seller’s nominated bank account or via a verified third-party payment gateway (e.g., PayFast, Peach Payments).
3.3. Error & Omissions (E&OE): In the event of a manifest pricing error, the Seller is not obligated to provide the product at the incorrect price and may cancel the order with a full refund to the Customer.
4. LOGISTICS, RISK, AND OWNERSHIP
4.1. Transfer of Risk: In accordance with Section 19 of the CPA, risk in the goods passes to the Customer upon physical delivery to the specified address.
4.2. Ownership: Legal ownership of the goods remains vested in the Seller until the purchase price has been paid in full and the funds are irrevocable.
4.3. Third-Party Couriers: While the Seller facilitates shipping, the Seller is not liable for delays caused by third-party logistics providers, industrial action, or "Acts of God" (Force Majeure).
5. USAGE LIMITATIONS AND LIABILITY
5.1. Domestic Use Only: Unless otherwise specified in writing, all kitchen and serveware are sold for domestic use only. Use in a commercial environment (e.g., restaurants or catering) voids all warranties.
5.2. Thermal Shock & Misuse: The Seller shall not be held liable for personal injury or property damage resulting from the misuse of products, including but not limited to:
* Subjecting cold ceramics to boiling water (Thermal Shock).
* Using non-microwave-safe items in a microwave.
* Inadequate storage leading to chipping or structural failure.
6. INTELLECTUAL PROPERTY
6.1. All designs, logos, and product photography associated with the [Your Business Name] brand are the protected intellectual property of the Seller. Any unauthorized reproduction for commercial gain will result in immediate legal action.
7. DATA PRIVACY (POPIA COMPLIANCE)

7.2. The Customer hereby consents to the processing of such data under the Protection of Personal Information Act (POPIA). The Seller warrants that no data shall be sold to third-party marketing entities.
8. DOMICILIUM AND JURISDICTION
8.1. The parties choose as their domicilium citandi et executandi (address for legal notices) the addresses specified during the checkout process.
8.2. Any dispute arising from this agreement shall be subject to the jurisdiction of the Magistrate’s Court in the district where the Seller’s head office is situated.
